Please read these terms carefully before using our services.
By engaging Home Care Maintenance LLC ("Company", "we", "us", or "our") for property preservation, maintenance, inspection, or repair services, the Client ("you", "your") agrees to be bound by these Terms and Conditions. These terms govern the relationship between the Company and the Client regarding all work orders, bids, and general services provided nationwide.
Home Care Maintenance LLC provides property preservation services, including but not limited to initial securing, winterization, debris removal, lawn maintenance, interior/exterior repairs, and inspections.
All services will be performed according to standard industry practices and, where applicable, in compliance with federal, state, HUD, FHA, or VA guidelines. We reserve the right to subcontract specific scopes of work to our fully vetted network of independent field contractors.
By submitting a work order to Home Care Maintenance LLC, the Client warrants and represents that they have the legal right and authority to authorize work on the subject property. The Client agrees to provide:
All bids and estimates provided by the Company are based on a visual inspection of the property at the time of assessment. Should unseen or hidden damage (e.g., foundation issues, hidden water damage, structural decay) be discovered during the course of work, the Company will halt work and submit a revised bid for Client approval before proceeding.
Unless otherwise stipulated in a separate vendor agreement, payment for services rendered is due upon completion of the work order and submission of the invoice along with supporting photo documentation.
Past due invoices may be subject to a late fee of 1.5% per month (18% annually) or the maximum allowable by law. The Client agrees to cover any legal fees or collection costs incurred by the Company in recovering overdue balances.
Home Care Maintenance LLC strives to secure and maintain properties to the highest standard; however, vacant properties carry inherent risks. Therefore, the Company shall not be held liable for:
Our standard crews are not licensed hazardous material handlers. If hazardous materials, including but not limited to asbestos, black mold, toxic waste, or structural biohazards, are discovered at the property, work will cease immediately. The Client will be notified and will be responsible for contracting a specialized environmental remediation service before our standard preservation work can resume.
The Client agrees to indemnify, defend, and hold harmless Home Care Maintenance LLC, its officers, employees, and subcontractors from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or connected with the Client's breach of this Agreement, or from third-party claims related to the legal ownership or right to access the property.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding arising out of these terms shall be brought exclusively in the state or federal courts located in Erie County, New York.
Home Care Maintenance LLC reserves the right to update or modify these Terms and Conditions at any time. Continued use of our services following any changes indicates your acceptance of the new Terms. We recommend reviewing this page periodically.
